Court of Appeals to convene Feb. 26 at USD A three-judge panel of the United States Court of Appeals for the Eighth Circuit plans to visit The University of South Dakota School of Law to hear oral arguments from 9 a.m. to noon on Feb. 26.
The court will hear four cases, all of which were appealed to the Eighth Circuit Court of Appeals from U.S. District Courts in South Dakota.
They include: Rosebud Sioux
Tribe v. Kevin Gover which centers on issues of environmental protection; United States v. Loud Hawk which involves federal charges of second-degree murder and use of a firearm during a crime of violence; United States vs. Arais, a criminal case involving possession, conspiracy to distribute, and use of an interstate communications facility with intent to distribute methamphetamine; and Siers v. Weber, in which Siers was convicted by a jury of second-degree rape and was sentenced as a habitual offender to 15 years in prison.
Chief Judge Roger L. Wollman, Sioux Falls, Judge Kermit E. Bye, Fargo, ND, and Judge David R. Hansen, Cedar Rapids, IA, will hear the cases.
