Four years penitentiary is suspended based on the following conditions: 1. Shall serve ninety days in county jail with 25 days credit. 2. After release from incarceration, defendant shall comply with the 24/7 program for 180 days. 3. Shall repay victim. 4. Shall repay this county for all court-appointed attorney fees. 5. Shall reimburse Clay County for any costs incurred in returning him from Missouri which are not paid by bonding company. 6. Shall be under supervision of court services and obey all rules, regulations and conditions imposed by them even though they may not have been specifically set out by this court. If he had financial obligations under this judgment, he shall work out a payment schedule with his probation officer. 7. Shall be subject to random search and seizure by probation or law enforcement officers upon reasonable suspicion that they are violating any provision of this sentence or of any probation agreement. 10. Shall pay all fines ordered by this court. 11. Shall obtain a drug/alcohol evaluation and comply with its recommendations for treatment and/or aftercare. 12. Unless attending an approved educational or training program, he must work regularly at a lawful occupation and support all dependents to the best of his ability.

Imposition of sentence is suspended based on the following conditions: 1. Shall be under supervision of court services and shall obey all rules, regulations and conditions imposed by them even though they may not have been specifically set out by this court. 2. Shall obey all Federal, state, local or municipal laws and be a good law abiding citizen in all respects. 3. Shall not consume alcoholic beverages of any kind, use or possess controlled drugs or substances including marijuana and shall submit to urine, breath, blood testing at any time requested to do so by their probation officer and shall pay for such testing. 4. Unless attending an approved educational or training program, he must work regularly at a lawful occupation or job and support all dependents to the best of his ability.

One year penitentiary time is suspended based on the following conditions: 1. Driver license is revoked for a period of one year after his release from incarceration. 2. Shall repay this county for all court-appointed attorney fees. 3. While incarcerated he shall satisfactorily complete any available alcohol treatment program. 4. Shall be under supervision of court services or board of pardons and paroles and shall obey all rules, regulations and conditions imposed by them even though they may not have been specifically set out by this court. Any financial obligations under this judgment shall be worked out with a payment schedule set up with their probation/parole officer. 5. Shall obey all federal, state, local or municipal laws and be a good law-abiding citizen in all respects. 6. During this period of probation he shall actively participate in AA.
