Three years in penitentiary is suspended based on the following conditions: 1. Shall be placed under the supervision of court services for a period of three (3) years and follow all conditions and requirements placed upon him by his court service officer. 2. Shall pay prosecution costs of $152.20 to the Clay County Clerk of Courts to be forwarded to the South Dakota Drug Control Fund. 3. Shall pay court costs of $104 to the Clay County Clerk. 4. Shall voluntarily submit to random search and seizure of his person and property at the request of his court service officer or any law enforcement officer upon reasonable suspicion that the defendant violated conditions of his probation and at his own expense. 5. Shall submit to urine, breath or blood test at any time requested by his court services officer at his own expense. 6. Shall continue with his treatment protocol with Dr. Stricherz. 7. Shall obey all local, state and federal laws. 8. Shall not possess or consume any alcohol, controlled substances, drugs and/or marijuana. 9. Shall maintain full-time employment or schooling during his time on probation. 10. Shall serve thirty (30) days in the S.D. Penitentiary, after his release from the penitentiary, he shall immediately go to Tallgrass Living Center and successfully complete 30 days treatment. Upon his completion of treatment he reports to the Clay County Jail to serve 150 days with work release for day-time work in his business. 11. If after thirty (30) days in the Clay County jail his THC Reading continues to go down, then he may be released from jail.
