June Hawley, PO Box 942, Brandon: Grand theft, costs, five years penitentiary. Two years penitentiary time is suspended based on the following conditions: 1. Shall be imprisoned in the South Dakota State Penitentiary for a term of three years, there to be kept, fed and clothed according to the rules and discipline governing said institution and is remanded into the custody of the sheriff of this county on June 18, 2010 for transportation to the penitentiary. 2. Shall make restitution to Dennis Waddington in the sum of $3,445. 3. Shall repay this county for all of their court-appointed attorney fees. 4. Shall repay the state of South Dakota for costs of prosecution in $22.40. 5. The Department of Corrections is requested to provide the defendant with whatever gambling addiction treatment and/or counseling they can make available. 6. Shall be under the supervision of Board of Pardons and Paroles and shall obey all rules, regulations and all conditions imposed by them even though they may not have been specifically set out by this court. If she has financial obligations under this judgment, they shall work out a payment schedule with their parole officer. 7. Shall obey all federal, state, local or municipal laws and be a good law-abiding citizen in all respects. 8. Shall not consume any alcoholic beverages of any kind, use or possess controlled drugs or substances including marijuana and shall submit to urinalysis, breath or blood testing at any time requested to do so by their parole officer and shall be responsible for the costs of that testing. She may not enter any premises where the sale of alcoholic beverages is their primary business. 9. Shall be subject to random search and seizure by parole or law enforcement officers upon reasonable suspicion that they are violating any provision of this sentence or of any parole agreement. 10. Shall pay all fines, costs and restitution ordered by this court. 11. Upon her release from incarceration she is to engage in a program of counseling and aftercare designed to prevent a re-occurrence of her gambling problems. With this concurrence of her parole officer this may include such addiction programs as AA. 12. Unless attending an approved educational or training program, she must work regularly at a lawful occupation or job and support all dependents to the best of her ability. 13. She is not to enter any premises licensed for any form of gambling.

Shall be placed under supervision of court services and shall obey all rules, regulations and conditions imposed by them even though they may not have been specifically set out by this court. If he has any financial obligations under this judgment, he must set up a payment plan with his court service officer. 2. Shall serve nine (9) days in county jail effective 9 a.m. on Dec. 1, 2010. 3. Shall repay Clay County for all court-appointed attorney fees.  4. Shall repay the state of South Dakota for costs of prosecution in the sum of $22.40. 5. Shall obey all federal, state, local or municipal laws and be a good law-abiding citizen in all respects. 6. Shall not use or possess any controlled drugs or substances including marijuana and shall submit to urinalysis, breath or blood testing at any time requested to do so by their probation officer and shall be responsible for the costs of that testing. 7. Shall be subject to random search and seizure by their probation officer or any law enforcement officer upon reasonable suspicion that they are violating any provision of this sentence or of any probation agreement. 8. Shall pay all fines, costs and restitution ordered by this court. 9. Unless attending an approved educational or training program, he must work regularly at a lawful occupation or job and support all of his dependents to the best of his ability. This would not apply during the normal off-season for his construction job.

Imposition of sentence is suspended based on the following conditions: 1. Shall serve 90 days in the Clay County Jail effective 9 a.m. on June 21, 2010. Shall be eligible for work release and may have a 24-hour furlough in July to attend a friend's wedding which time will be added onto the end of his sentence. 2. Shall make restitution to CLG, LLC (Chad Grunewaldt) in the sum of $136,666.67, if the state may pursue a larger amount of restitution if they desire by scheduling this for a restitution hearing. 3. Shall repay the state of South Dakota for costs of prosecution in the sum of $28.05. 4. Shall be under supervision of court services and shall obey all rules, regulations and conditions imposed by them even though they may not have been specifically set out by this court. If he has financial obligations under this judgment, they shall work a payment schedule with their probation officer and if deemed necessary, shall execute a wage assignment form. 5. Shall obey all federal, state and local or municipal laws and be a good law-abiding citizen in all respects. 6. Shall not consume any alcoholic beverages of any kind, use or possess any controlled drugs or substances including marijuana and shall submit to urinalysis, breath or blood testing at any time requested to do so by their probation officer and shall be responsible for the costs of that testing. 7. Shall be subject to random search and seizure by probation or any law enforcement officer upon reasonable suspicion that they are violating any provision of this sentence or of any probation agreement. 8. Shall pay all fines, costs and restitution ordered by this court. 9. Shall obtain a drug and alcohol evaluation and comply with its recommendations for treatment and/or aftercare. He shall provide a copy of the report so that it can be determined whether he was forthright in what he reported to the evaluator. 10. Unless attending an approved educational or training program he must work regularly at a lawful occupation or job and support all his dependents to the best of his ability.
