 David Austin, 4302 Piece Dr., Norfolk, NE: Driving under influence – third offense, Recharged; Driving under influence – third offense, costs, 180 days penitentiary. Two years in the state penitentiary is suspended based on the following conditions: 1. Shall serve 180 days in the Clay County Jail with 50 days credit for time served. May serve in a different location at his own expense if he can arrange it. 2. Shall be given credit of 52 days towards sentence. 3. Driver's license is revoked from today's date until one year after his release from incarceration. 4.Shall repay this county for all court-appointed attorney's fees. 5. Shall repay the State of South Dakota for costs of prosecution in the sums of $75 and $44.55. 6. For a period of one year after his release from incarceration, the defendant shall be involved in some form of monitoring to assure that he is not consuming alcohol, such as 24/7 or SCRAM. Since the defendant is probably leaving South Dakota and the court is unsure what forms of monitoring will be available, this must be a monitoring program approved by his court services officer. 7. Shall be under the supervision of court services and shall obey all rules, regulations and conditions imposed by them even though they may not have been specifically set out by this court. If he has financial obligations under this judgment, he shall work out a payment schedule with his probation officer.  8. Shall obey all federal, state and local or municipal laws and be a good law-abiding citizen in all respects. 9. Shall not consume any alcoholic beverages of any kind or use or possess any controlled drugs or substances including marijuana and shall submit to urinalysis, breath or blood testing at any time requested to do so by their probation officer and shall be responsible for the costs of that testing. May not enter any premises where the sale of alcoholic beverages is their primary business. 10. Shall be subject to random search and seizure by probation or law enforcement officers upon reasonable suspicion that they are violating any provision of this sentence or of any probation agreement. 11. Shall pay all fines, costs and restitution ordered by this court. 12. Shall obtain a drug and alcohol evaluation and comply with its recommendations for treatment and/or aftercare. 13. Unless attending an approved educational or training program he must work regularly at a lawful occupation or job and support all of their dependents to the best of their ability.
