NOTICE OF PERMIT AMENDMENT, CITY OF VERMILLION
Recommendation by the Department of Environment and Natural Resources
The South Dakota Department of Environment and Natural Resources (DENR) has received an application from the city of Vermillion to amend the permit for operation of a Type IIA municipal solid waste landfill located in the SE _ NW _ and SW _ NE _, Section 34, T93N, R52W, Clay County, South Dakota. The facility serves Clay County and the surrounding region. The permit amendment will be granted until February 18, 2015 as provided for under South Dakota Codified Law (SDCL) 34A-6-1.15.
DENR has reviewed the proposed amendment, has reached a tentative decision and recommends to the Board of Minerals and Environment (board) that the permit be amended to allow the landfill to vertically expand by 24 feet. The amendment request also proposes to use an alternative liner system for future waste disposal areas. The operational and design requirements of the permit are specifically designed to ensure the landfill will not pose a hazard to human health or degrade the environment.
In accordance with SDCL 34A-6-1.14, DENR's recommendation of approval will become the final decision on the permit application and this permit will be amended 30 days after publication of this notice. A person adversely affected or having an interest adversely affected by the DENR's recommendation of approval may petition the board for a contested case hearing. The petition must comply with the requirements of ARSD 74:09:01:01. If a petition for such a hearing is not filed within 30 days of this publication date, a permit renewal will be formally and finally granted at that time.
