AN ORDINANCE OF CLAY COUNTY, SD, REPEALING ORDINANCE NO. 94-5, DRAINAGE PERMIT
ORDINANCE OF CLAY
WHEREAS, pursuant to South Dakota Codified Law 46A-10A, the Clay County Board of Commissioners adopted Ordinance No. 94-5 on September 20, 1994; and
WHEREAS, the Clay County Board of Commissioners now wishes to no longer exercise the authority to oversee and regulate rural drainage in Clay County under South Dakota Codified Law 46A-10A.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF CLAY COUNTY, SD, that:
Section 1. That Ordinance No. 94-5, Drainage Permit Ordinance of Clay County, South Dakota is hereby repealed.
Section 2. The Clay County Board of Commissioners encourages individuals proposing drainage projects to contact all downstream landowners for at least _ mile below the proposed outlet to show and discuss the proposed project.
Section 3. Upon completion of a drainage project, an as-installed drawing or map is highly encouraged to be filed with the Clay County Register of Deeds, for public record.
